Registration of Professional Tax - PTRC/PTEC
The distinction between PTEC and PTRC is fundamental for your clients' compliance—especially given your focus on ITR and GST services.
In the context of the Maharashtra State Tax on Professions, Trades, Callings and Employments Act, 1975 (which is a common benchmark for these registrations), here is the breakdown of both certificates.
1. PTEC: Professional Tax Enrollment Certificate
This is for the entity or individual itself. It is a certificate showing that the business (or professional) is "enrolled" to pay their own professional tax.
- Who Needs It: Every business entity (Company, LLP, Partnership, Proprietorship) and individual professionals (CAs, Doctors, Lawyers, etc.)
- Purpose: To pay the organization's own annual professional tax (usually a flat ₹2,500 per year in Maharashtra).
- Key Detail: Even if you have zero employees, you must still have a PTEC to pay the tax for the business/proprietor.
- Due Date: Generally June 30th of every year (though specific deadlines can be revised).
2. PTRC: Professional Tax Registration Certificate
This is for the employer. It is a registration that allows the business to act as an agent to deduct tax from employees' salaries and deposit it with the government.
- Who Needs It: Any business that has employees whose monthly salary exceeds the tax-exempt slab.
- Purpose: To deduct and remit the Professional Tax of the employees.
- Key Detail: If you have employees but their salaries are below the slab (e.g., below ₹7,500 for males or ₹25,000 for females in Maharashtra), you may still need the registration if you intend to hire above those limits later.
- Filing: Unlike PTEC (which is just a payment), PTRC requires monthly or annual returns depending on the total tax liability.
Documents Typically Required for Registration
Since you often assist clients with documentation, here is the standard checklist:
- Identity Proof: PAN Card of the applicant/business.
- Address Proof: Electricity bill, Rent Agreement, or Property Tax receipt of the business premises.
- Entity Proof: Certificate of Incorporation, Partnership Deed, or Shop & Establishment License.
- Bank Details: Cancelled cheque or latest bank statement.
- Employee Details (for PTRC): List of employees with their gross salary and dates of joining.
IMPORTANT NOTE -
A Private Limited Company or LLP in Maharashtra often needs both registrations. The PTEC covers the company's own liability as a legal "person," and the PTRC covers its role as an employer.
